The administrative hearing system is the key system of modem administrativeprocedure law. In1997, according to China’s "Administrative Penalties Law", Liaoningprovince formulated the " Temporary Provisions of Administrative Penalty HearingProcedure in Liaoning Province". For the first time, it introduced the administrativehearing system, which plays an important role in guaranteeing the legal rights ofadministrative counterparts and scientific and democratic administrative decision-making.With institution change theory, it analyzes the evolution of administrative hearing system,problems and countermeasures in Liaoning province so as to further improve it. It aims toenable this system to develop constantly in Liaoning province in order to realizedemocracy, fairness and justice.Based on the evolution of the administrative hearing system in Liaoning province,with the analyzing framework of institution change theory from Douglas North, thispaper starts from three aspects: behavioral hypotheses, change cost and path dependenceof institutional change. The research scope is limited to Liaoning province. By analyzingsystematically the evolution of the administrative hearing system in Liaoning province,this paper summarizes actual problems and causes during the implementation.Combing with the institution change theory, it gets out the solutions for the problems.This paper is divided into five parts. The first part is about the purpose, significance,literature review, innovation and research methods of this paper. The second part definesthe concepts of the hearing system, administrative hearing system and institutionalchange and expounds the institution change theory from Douglas North.The third partdiscusses the change course of the administrative hearing system in Liaoning provinceand studies the background of the changes. The fourth part puts forward the problems oflittle system innovation, high cost of institutional change and difficult orientation ofinstitutional change during the change course. It also analyzes the reasons. The fifth partproposes the solutions for these problems. The solutions are mainly about determiningthe value orientation of administrative hearing system, reducing institutional-change costand transaction cost and improve the system change path so as to promote the positiveand benign changes of administrative hearing system in Liaoning province.Combining the theory with reality, this paper researches the change course of the administrativehearing system in Liaoning province. Based on the institution change theory fromDouglas North, it also studies the problems since the introduction of the administrativehearing system, with the purposes of advancing the administrative hearing system inorder to safeguard social fairness and justice and promote the stable development of thesociety. It has significant meaning for promoting the positive and benign changes ofadministrative hearing system in Liaoning province, accelerating the legal construction ofsocialism and building harmonious society.
