A Study Of The Public Participating Government Budget In The Vision Of Constitutionalism

At present, China is in an important period of social transition. The government budget，which is an important part of the financial system, gains more and more public attention aslong as the improving of the reform progresses. But in the real life, the unhealthy tendency,such as the corruption caused by the financial opaque, is hindering the rapid comprehensivedevelopment of China. To stop it getting worse, the public should participate in the process ofthe government budget actively to create a “sunny finance policy”, which can accelerate thedemocratization process of constitutional government.In order to solve the present problem, push forward the financial system reform of ourcountry, this paper try to propose a government budget system which conform to China’snational conditions, and strive to establish a complete system, according to compare the factsand theories of the public participation and the qovernment budget at home and abroad.The first part of this paper gives the accurate definition of the words” governmentbudget” and “public participation” after synthesis the point of view of the domestic andinternational scholars. It can help people to understand these two systems better.The second part illustrates the origin theory of the “government budget” and “publicparticipation”. It includes people’s sovereignty theory, participatory democracy theory andfinancial constitutional theory. Through the analysis of the theory, we know that to complete asystem, a solid theory should support behind.The third part analyzes it from the realistic angle that there are many disadvantages andseries of negative effects in the development of the government budget system of our country.To change the situation, we must find out the solution fundamentally, base on the analysis ofthe cause of formation.The fourth part analyzes the government budget system and the mature operationmechanism of the public participation in the government budget system in American, theGreat Britain and Japan. Compared with our country, they provide many successfulexperiences and useful inspirations, which we could reference in the construction of oursystem.The fifth part puts forward that the government should bring the public participation in the government budget system, which could make it perfect. Firstly, the public participationsystem should be signed into law to make it legality. Secondly, the information about thebudget should be open to the publics. Thus the public could participate in the economic andsocial life better. Thirdly, the budget hearing system should be intensified. It can createconditions to make sure that the public could participate by themselves. Finally, the educationof the knowledge on the budget should be strengthened, which makes the public truly careabout their own profits, and exercise adequately all the rights.To advance the reform of the financial system, the major measures should be taken essen-tially to change the government budget system at present. Increasing the public participation,working hard to make fiscal transparency, construct a more fair and harmonious society.
