The Research On Legal Issues Of The Government And Charitable Career

2008, the State Council has made "promote the charity’s Republic of China Law" included in the State Department’s annual legislative plan. Currently, Ministry of Civil Affairs has completed the framework of the draft law, which indicates that the process of the China’s charity career has greatly step forward, and it also expressed the will and the determination of our country’s to develop charity career. China has long history of philanthropic culture, however, our charity didn’t well developed because of imperfect legal system of charity, charitable organizations, low capacity, in the role of philanthropy in the development of dislocation and lack of professionals. This paper based on previous studies, and with the view of "charity promotion law" as an opportunity to complete the draft framework, government’s role in philanthropy positioning perspective of legal research conducted a series of demonstration and explained. This paper include three parts:the introduction, body and conclusion.Introduction is the first chapter of the article, the background of general topics, literature review, research methods, and innovation; conclusion is the chapter six, it is the summery of the point of view the full text, subject, the body part is the main part of the article, it include the second, third, fourth and fifth chapter.The second chapter, from the charity and the meaning and specific characteristics of philanthropy, it described the history and philanthropy and related concepts, and investigate the reality of charity and feasibility of the development.The third chapter, it analyses the defects and shortcomings of the development of China’s charity and the bottleneck problems which are should be solved in the process of development.The fourth chapter introduces the overview the development of Anglo-American philanthropy and put forward several suggestions which is learned from Britain and other countries so that they can be used well by China’s charity.The fifth chapter put forward the Government’s legal status in the charity careers.In short, I hope this paper can contribute to the development of our charitable.
