Since the1980s, with the rapid development of radio and television, radio communication technology, and high-voltage power transmission and transformation technology, electromagnetic radiation to cause health damage theory increasingly aroused public attaches great importance to the environment caused by the electromagnetic radiation infringement dispute litigation increasinglyincreased. The electromagnetic environmental infringement cases Frequent not only has become a major problem affecting the telecommunications, electricity, radio and television enterprises normal production and operation order, brought a lot of pressure because of its identified on the particularity to the people’s court to deal with such cases. Therefore, how to correctly understand the electromagnetic environment tort laws, an accurate grasp of such cases in the dispute, make reasonable and legitimate, more convincing for the current sentence, creating a "harmonious society ", maintain social stability, safeguard the legitimate rights and interests of enterprises is of great practical significance. The aim of this paper is to with specific electromagnetic environment infringement cases for lead, combined with the current situation of electromagnetic environment tort case, clear electromagnetic environmental tort legal elements, from the cognizance of causation, adjacent relations, immission identification and the principle of the interest balance for four perspective on the judgment of the case of legal analysis of rationality, find out the sentences, and in conclusion part will improve electromagnetic environment legal system and the correct guidance of the judicial practice put forward their views and suggestions.
