New Challenges And Countermeasure Studies Of Public Security Traffic Control After "Criminalization Of Drunken Driving"

"Criminalization of Drunken Driving" is one of the important highlights and hot issues. In order to support the implementation of the provision of "Criminalization of Drunken Driving", a new Road Traffic Safety Law has been approved by Standing Committee of the National People’s Congress, and the Guidance on Dealing with the Criminal Cases Involving Drunken Driving for Public Security Organs has been issued by the Ministry of Public Security. Even so, after the Amendment8to the Criminal Law comes into effect, the provisions of "Drunken Driving into Criminal Law" have met many problems in the judicial applications.This article objectively analyzed the new problems faced by the public security traffic control after "Criminalization of Drunken Driving" beginning with the legislative background and process of "Criminalization of Drunken Driving", starting with the comparison on the provisions of driving crime both at home and abroad, and combining with the achievements achieved by "Criminalization of Drunken Driving" in the past year. The innovation in this article is that the countermeasures of the department of public security traffic control for "Criminalization of Drunken Driving" has been proposed from the respective of enforcing the law for the people, combining with the actual work of public security traffic control in our province:Standardize law enforcement, strengthen the collaboration between all the departments, built reasonable duty model, tighten the supervision on law enforcement, improve the implementation of drunken driving check, promote the standardization construction of law enforcement site as well as publicity.The writer believed that "Criminalization of Drunken Driving" suppressed dangerous driving to a certain extent. It not only meets the actual requirements for maintaining traffic order and punishing the crimes involving traffic cases, but also fully reflects people’s concerns and expectations on traffic safety and public safety. For the new task and challenge, the department of public security traffic control must quickly change their minds, enhance learning, grasp the characteristics and rules of the cases, constantly improve the measures of public security traffic control, enhance the law enforcement ability and level, to ensure road traffic safety in a better way and protect people’s lives and properties.
