Discussion On The Legal Regulation Of China’s Pawn System

Pawn has a long history in China, throughout history, pawn industry in our country was experienced budding, development, flourishing-recession-the revival of historical change. Pawning industry can be summed up as follows:originated from the Han Dynasty, beginning in the Southern Dynasty Buddhist temple, into the customs in the Tang Five Dynasties, vertical lines in the north and south two song, Ming and Qing Dynasties on the rise in two quarter, decline in the late Qing Dynasty, and revived in Contemporary reform. Theoretical differences, a lack of legislation, Judicial Dilemma in practice, government management fuzzy to some extent hindered the pawn industry long-term development.The first part of this paper from China’s pawn system historical development begins to discuss.The second part of the pawn system on the basic theory problems of pawn. The third part of the author in the trial practice encountered in the real case. The fourth part focused on Chinese pawn system for reflection and perfection of legal system of pawn.I know very well, pawn the perfection of the legal system is not a short duration of time of work, because of the limited level of pawn, the legal principle theory of just see a segment of a whole, but the author believed that, the more truth is identified more clearly, I hope this paper can attract more law counterparts, which joined the code when study, the pawn industry development no more free in legislative system.
