Studay Of Standardizaiton Of Criminal Prosecution Procedures

Standardization is a new area, with which the prosecutorial organ continuously for themechanism reform. It has been through a procedure with recognition constantly intensifyingand practice constantly accumulating. Since many years the Supreme People’s Procuratoratefocus on the base foundation of the ground floors and regard it as the priority in the strategicdevelopment. But there is also balancing problem in the procuratorates of ground levels. Itdepends on the environmental impact, attention degrees of the leadership and work methods,etc.. From the view of the system, a standard system for measuring the construction of theground level procuratorates is lacking, that each procuratorate has its own work standardaccording to their own understanding, or has even no work standard. From the view of thetheoretical support, the management of the prosecutorates is shortage of mature systematictheories. If a management has no systematic theories to support in the practice, it could hardlysuit the new work requirements to adjust the traditional mode and thinking logics. In summary,a consistent work standard for prosecutorates is extremely urgent. This article willbreakthough from the standardization of the prosecution procedures, and analyze theoretically,how to realize the standardization, and give a system concept. It divides in to three parts ofintroduction, description and conclusion. The body has three chapters with about24000words.Chapter Ⅰ: definitions of the standardization and standardization of prosecutionprocedures, including features of the standardization of prosecution procedures, andelaboration of the guiding theories of the importance of the standardization of prosecutionprocedures.Chapter Ⅱ: description of the current situation of the national prosecution procedureswith3parts: Part I describes the situation of the prosecution procedures from the legislativeview; Part Ⅱ describes the situation of the prosecution procedures from the judicial view; PartⅢ focuses on the national situation of the standardization of prosecution procedures.Chapter Ⅲ: suggestion for the national standardization of prosecution procedures and asystem concept; Introduction of the theoretical basis of the standardization of prosecutionprocedures with practical guiding principles and a concept of realization of the prosecutionprocedures.
