In contemporary market-oriented economy, advertisement plays an very importantrole in market competition for participators. Operators demonstrate the positivefactors of their goods or service to the consumers via advertising to obtain idealmarket share. Therefore, advertisement is one critical booster of modern marketmechanism, which could effectively promote the market competition among operators.However, as the social practice proving that the advertisement is a double-edgedsword. When the market competition reaches a certain level, especially the white-hotstage, perhaps advertising becomes a tool of illicit competition for some operators.Therefore, unfair advertising undermines seriously the market competition orderinstead of furthering positively and maintaining market competition. Thus, besidesmost countries all over the world make provision for the unfair advertising, eachnation’s competition act give high degree of concern for the improper advertisingconduct.
