An Empirical Research On The Entrusting Enforcement System

As a part of the Civil Enforcement System，the Entrusting Enforcement Systemplays an important role in cracking puzzles in civil enforcement、Safeguarding thelegitimate rights of the parties and the legal authority。But in judicial practice，theEntrusting Enforcement System has not achieved the supposed objective and effect bythe legislators, some problems were exposed.In the future, with the development of economy and society，the amount ofinter-jurisdictional enforcement cases will increase gradually. Finding the way toimprove the Entrusting Enforcement System and to solve the puzzles ofinter-jurisdictional enforcement is an urgent task for law workers. Based on theprimary court’s entrusting enforcement practice and analyses，this article will beabsorbed in the introduction、the current status and the improvement of the EntrustingEnforcement System comprehensively.This article can be divided into four parts:Chapter one introduces the conception、the legal characteristics、the superiority、the conditions and the procedure of Entrusting Enforcement System briefly。Inaddition，it reviews the legislative history of Entrusting Enforcement System. Seenfrom these，it’s necessary、reasonable and feasible to establish the Entrusting Enforcement System in our country。Chapter two surveys the characteristics and the situation of EntrustingEnforcement System in primary court, and then summarizes some useful experience.Combined with the writer’s actual work, Chapter three is a completely analysisof the various problems during the course of Entrusting Enforcement System, and italso states the cause behind these problems.Based on the former two chapters, chapter four gives some strategies to breakinter-jurisdictional enforcement puzzles and Entrusting Enforcement System. First ofall, we should establish and improve the broad sense of National Civil LinkageMechanism, expand its coverage, strengthen mutual cooperation, and give analternative measure for the Entrusting Enforcement System. Then, the writer givessome specific strategies for how to improve the current Entrusting EnforcementSystem and strengthen the related work in court.
