Conflicts And Resolution Between Trademark Rights And Trade-name Rights

As common commercial marks with similar distinguish function,trademarks and trade-names with the same or similar in identifyingsources of products or services are very likely to cause confusion. Withthe continuous development of market economy, people have becomeincreasingly aware of the importance about trademarks used todistinguish products and services and trade-names used to distinguishproduct or service providers. However, inappropriate or illegal use oftrademarks and trade-names will lead to intense conflict betweentrademarks and trade names. This thesis takes the case of "Big Bright"trademark dispute as a starting point, and conducts in-depth analysis oftrademark rights and trade-name rights, analyzes the conflicting typestogether with reasons for the formation of disputes between trademarkrights and trade name rights as well as learning mature experience from other countries. Finally, this thesis put forward proposals to resolveconflicts between trademark rights and trade-name rights.
