After Tim Berners-lee’s invention in1991, the internet technology has gained increasingly wider range of applications, the internet based internet advertising is one of the important applications of internet. With the development of Internet technology, this kind of new-style advertisement is playing a more and more important role in market economy.But it also raises a series of problems in the course of the its rapid development,which brings some adverse effects to the market, the infringement of online advertising is one of the problems.Compared with the traditional tort, the network advertisement tort has a different meaning and feature, which is due to network tort advertising new traits and the tort of network advertisement type diversity decision. Even so, but current religion, network advertisement tort is a kind of infringement, using the basic theory of tort on it will also get the network advertisement torts, the four elements of tort, imputation principle, form of responsibility and liability also is the study of the network advertisement tort starting point. The use of such methods can hold a network advertisement tort on the main line, but also can not deny that practice is the emergence of a network advertisement tort accountability difficult phenomenon, must also be admitted that the law in the regulation of Internet advertisement tort appears on the problem of lag, which leads to the network advertisement nature is difficult to define, the network advertisement main body hard clearly, the network advertisement lowering the threshold leads to human rights problems and so on. Therefore, we should improve the legislation of network advertisement from the aspect of the law, and strengthen cooperation, and establish corresponding administrative regulations to strengthen the network advertisement management and review, then strengthen the industry guidance and supervision of external supervision mechanism, build, system of seeking a solution to the problem.
