Investigation Of The Parole System In Our Country

The parole system plays a very important part in our justice practice. With the development of the society, the penal philosophy gets continuous improvement but some drawbacks of the parole system are gradually becoming apparent. If the problems of parole system can’t be adjusted and improved, the repeated illegal crime rate can’t be reduce, and the process of the legal system society construction in China even be affected. The effective measures must be taken to improve the parole system. Taking prison in Hunan Province as the example, this paper investigated status and reasons of parole system in our country from the basic theory of parole system such as history, evolution, concept and main function. And the resolved measures and methods were suggested. In this paper’s view, the parole system had some problems, such as low applicable rate in parole, legislation flawed, applicable procedures unscientific, judicial detennination passive, offenders’rights poor ensured and community corrections un-established. These problems were caused by the concept lag, unsound legislation, defective system, sensitive liability risks and imperfect community corrections. The positive and normal effect on parole system was greatly affected. So it is very important in the legislation to refine the specific conditions of the parole system, give recidivism and serious violent offenders the right to parole, expand the applicable of the parole scope for juvenile offenders and economic criminals, and enhance the universality of parole. And it is very important in the judicial applicable to update the law enforcement ideas, transform the judicial concept, establish the correct concept with modern trends of execution, and improve the parole epochal character. To increase the authority of the parole, it is necessary to establish the special parole decision institutions by the ways of institutional settings, responsibilities fulfilling, and process examining and so on. The fairness of parole was improved by establishing and improving the parole recidivism prediction mechanism. And the social adaptability of parole after criminals was improved by completing the system of community corrections. Through improving the applicable concept of legislative and judicial, the parole system with fewer defects will be established ultimately. Solve many existing problems; maintenance the fairness and effective of parole system, and promote social harmony.
