Study On China’s Underage Labor Law Protection

The problem of child labor as an international issue, the internationalcommunity on the importance of continuous improvement, have issued a series ofpolicies and laws to control the social problems, such as the International LaborOrganization in1973promulgated the "Convention on the minimum age foradmission to employment", promulgated in1999,"the worst forms of Child LaborConvention". China has in1998and in2003to join the two conventions. China is inthe primary stage of market economy, the economic legal system to be perfect, so thephenomenon of child labor can not be avoided in the present stage is development ofour country, the problem of child labor strength and full range of necessarygovernance. The child labor problem must start from the root of the problem to makethis problem completely eradicated, and should start from the source governance willbe doomed to child labor in the next period of time is arduous and complex task.This paper is divided into four parts to analyze the problem of legal protection ofchild labor in china:The first chapter defines methods by comparing the legal concept of child labor,with age as the dividing line to clearly distinguish between children and theirrespective legal concept of child labor.The second chapter mainly value orientation of the legal protection of childlabor analysis. In the "Convention on the rights of the child" as the breakthroughpoint, elaborated in children’s rights include the right to life, the right to developmentcontent, protected rights and participation rights. At the same time, the way to realizethe rights of children to be clear, established the national, social and guardians of thetrinity of child rights approach.The third chapter mainly elaborates the generation of China the issue of childlabor, child labor, including the current situation of our country, our child labor typeof child survival crisis, which focuses on the formation mechanism of thephenomenon of child labor in China, were analyzed, in order to find out the childlabor problem predicament. The fourth chapter in the first three chapters on Chinese labor protection shopsaid focuses on the legal regulation on the issue of child labor in China at the presentstage and future in our country needs to be perfected in the field of child protection.
