It's a basic principle set up in the current international society that the underage dependants are given the special judicatory protection in the field of criminal judicature. It has been commonly recognized by major countries to give underage criminals the special protection. How to follow up the basic principle is an urgent problem to solve in our country. This paper sets forth several basic categories related to the criminal judicatory protection given to the underage dependants. Afterwards it expatiates the current situation of the legislation and the judicature and the deficits and harms existing in the two fields about the criminal judicatory protection given to the underage dependants in our country, and analyses the primary reasons. The paper adopts the comparatively investigative method to introduce the basic situation in respect of the criminal judicatory protection given to the underage dependants in US, Germany, Japan, etc. in order to use their advanced judicatory experiences for reference. The necessity and importance of this special protection are emphasized by the rational thinking of the criminal judicatory protection given to the underage criminals. In addition, the paper proposes an assumption of how to solve the current problems finally. The aim of this paper is to state the harms brought by the deficits of the criminal judicatory protection given to the underage dependants, and is to establish an effective judicatory operational administration on the basis of the protecting notion and utilize it to guide legislative and judicatory practice in order to actually guarantee the litigant right of the underage dependants, which will help them return smoothly to the society.
