Study On The Issue Of Corruption And Bribery Crime Of The Death Penalty

At the end of the twentieth Century, our country experts and scholars put forward the abolition of corruption and bribery crime death penalty, since then, corruption and bribery crime death penalty abolition problem has become a hot topic of our country, criminal law.corruption and bribery crime whether death penalty should be abolished into the controversy. In2011of "criminal law amendment (eight)" immediately abolished13nonviolent economic crime death penalty, such a large area of the death penalty reform is undoubtedly pushed the death penalty of corruption and bribery crime intoxicated the teeth of the storm.Currently on the abolition of capital punishment of corruption and bribery, there are three main ideas, the first view advocated the abolition of the death penalty corruption and bribery; second view holds that it is appropriate to maintain or increase the death penalty charges of corruption and bribery number; third view advocates the retention corruption and bribery under the premise of the death penalty, capital punishment for corruption and bribery limit the scope of strict implementation of the program, take the gradual abolition of the death penalty on the road of corruption and bribery.This article is based on three views of death penalty abolition of crime of corruption and bribery, launched China’s current corruption and bribery retained the death penalty in China. Secondly, the author explores the conditions which our country abolished the death penalty of corruption and bribery crimes should be had. Finally, The author advocates from perfecting the death penalty of corruption and bribery in criminal legislation and criminal justice, proposed "Criminal Law" and "restrictions on death row commutation proceedings in cases of certain issues" for amended to increase the corruption and bribery death row principal punishments and supplementary punishments restrictions commuted.
