Now, climate changing has been a global problem and been widely concerned by international society.Climatic deterioration caused environmental pollution, ecological damage and other problems, so that some areas are not suitable for human survival, thus making these people who originally lived in the area were forced to leave, become "climate refugees" Because of climatic deterioration, legitimate rights and interests of the people has been damaged, and badly need necessary laws to regain their legitimate rights. But viewing the international conventions on climate problems or refugee problems, there are not good the regulation on protection of the rights for the climate refugees, and the interest of special groups do not obtain the effective protection.The viewpoint of the article consider that:first of all, it should belong to the category of climate refugees due to refugees, the international refugees and international climate related laws and regulations have ever lagged, climate refugees is not recognized, their harm are very difficult for relief, and the climate refugee protection will not be effective. Therefore, climate refugees should be established in legislation, in order to provide legal basis for the protection of the lawful rights and interests. Secondly, we should establish and improve the accountability institution of the climate refugees, clarify national responsibility that caused climate refugees, make the climate refugee protection become more feasible. Finally, when establishing the sound climate refugee protection system, we should also play the role of international organizations, and establish a climate refugees compensation fund, in order to achieve the purpose of protecting the climate refugees. China also should formulate relevant laws on climate refugee protection to promote climate Refugee Rights protection.On the basis of the security measures, it needs to strengthen the international cooperation on climate issues. Climate refugees are caused by climate problems, so only under the circumstances of taking effective measures to solve the climate problem the in international community, is the problem of climate refugees sure to be within our grasp.
