Research On The Administrative Remedy System Of The Right To Education Of The Citizens

The right to education is a basic human right of citizens, is constitutionally protected fundamental rights. In the country’s education in the legal system, constitution and education law on citizens’ right to education have done a full provisions. However, with the depth of China’s reform and opening up a variety of social conflict of interest and a variety of social subjects contradictions and disputes, many problems in the protection of citizens’ right to education. Fully protect the citizens’ right to education has given rise to concerns of the community. On the basis of the existing literature related to this topic in-depth study and reflection, combined with the specific case, follow the objective laws to solve the problem, study and learn the successful experience and practice of foreign citizens by the administrative law point of view in-depth study administrative relief of the right to education issues and put forward relevant countermeasures.This article is divided into three parts, first of all analytic theories of the citizens the right to education administrative relief, described the concept of citizens’ right to education administrative remedies, the significance and the extraterritorial citizen the right to education administrative relief experience. Second, according to the order of the citizens the right to education law relief has analyzed the citizens the right to education in the representations of relief, six administrative reconsideration relief and administrative proceedings relief. Finally, the problems mentioned above, respectively improve our citizens’ right to education administrative remedy specific recommendations necessary to improve the representations of the citizens the right to education system, the administrative reconsideration system for the right to education, right to education, administrative litigation system.After reform and opening up30years development, the field of education in China has made considerable progress, the rule of law, according to the law to teach the development of education in our country the only way. In order to boost the sound development of China’s education, in order to protect every citizen the right to education, we must find effective ways and means to protect that right. This paper presents the perfect right to education, non-litigation system-education complaint system and the right to administrative reconsideration system; perfect right to education litigation system-the right to education administrative litigation system; the establishment of a special relief system of the citizens the right to education-the establishment of civil the right to education litigation courtroom system recommends that the full range of protection mechanisms will be provided to our citizens the right to education.
