The right to education is a fundamental human right of constitutional protection of citizens,as a basic right enjoyed by the citizens.In our country's education in the legal system,the constitution and the education law of the citizens' right to receive education are made more fully.But,along with our country reform and open policy thorough,the various social conflicts and social principal contradiction dispute,there are many problems in the aspect of citizens' right to education guaranteed.Fully guarantee citizens' right to education has drawn the attention of the society from all walks of life.This paper takes human rights as the angle of view.It first overview of the citizens' right to education,then,further analysis the meaning of the right to education and legal attributes,summarizes the legal protection of the right to education.Research on the citizens' right to education guaranteed in China the status quo and existing problems,analysis of the status quo,from the domestic law and international treaties on two aspects for protection of citizens' right to education,analyzes the current situation,points out the education for what problem there.Study abroad protective regulation for the right to education,particularly in this paper,the countries such as Japan and the United States education system,to gain perfect enlightenment to its protection in our country.We will mainly depends on a basic framework of constitutional rights,the constitution level meaning of the detailed analysis of the right to education.On the basis of systematically through the above analysis,put forward the Suggestions of perfecting our country's citizens the right to education.And considering the constitution of the academic circles usually countermeasure study\"practice\",in our educational legal protection for China to perfect the countermeasure research before,properly comb and refers to the foreign educational legal protection,and many other educational experience,combining with the condition of our country,put forward some can draw lessons from.In order to ensure the relative integrity of the article,in the last part of the legal protection of citizens' right to receive education in our country is,respectively,in the legislative,judicial,law enforcement and practice four aspects to make the corresponding theoretical research and analysis in the context of constitutional law professional disciplines discussed and prospected.
