Parallel import is a non-counterfeit product imported from another country without the permission of the intellectual property owner. Parallel imports are often referred to as grey product, and are implicated in issues of international trade, and intellectual property.Because of manufacture’s wholesale price discrimination, price differences of Intellectual property products exist between different countries, which makes the generation of cross-border trade. Parallel importation is the result of intellectual property and international trade, and has been the focus of global trade debate in international trade. As The Agreement on Trade-Related Intellectual Property Rights (TRIPS) leave this problem to each country, Many countrie have their own legislation on parallel importation.however, there is controversy even in the issue of whether to allow this trade,particularly in the trademark field,. Since joining the WTO, many Chinese legislation on international trade are the light of the WTO’s agreements, but in the issue of parallel imports, due to the lack of direct international legislation, China doesn’t have its clear attitude. Recalling the previous management, we can see the court’s attitude is quite different in different cases,, How to select and manage parallel importation is becoming China’s current problem.This paper analyses from the basic concept of trademark parallel imports and its origin and form, and tries to find its price impact, quantity impact, consumer surplus,, producer surplus, and total market welfare of with using of welfare economics-related knowledge. The paper also brings up some other problems that parallel imports bring, parallel imports in china’s maket are also be studied.The study involves China’s legislation,management methods,pratical cases and use of game theory.Afte that, this article studies the situation in the United States, Britain, Singapore and other countries,, tries to find similarities and differences by horizontal comparison, in oder to draw the direction of legislation and to find measures in the management of parallel imports.
