The Rectifying System For Minor Crime

With increasingly serious minor law-breaking and crime, minor law-breaking and crime has become one of the public nuisances in today’s society. Countries take active preventive measures for the minor criminal behaviors and make effective educational correction for the minor that has implemented crimes. Currently, our minor law-breaking and crime is rising. For the growing minor law-breaking and crime status, our country should both make the minor crime prevention work and carry out educational correction for the minor that has implemented crimes which is of great significance to prevent and reduce the incidence of minor law-breaking and crime behavior, correct the minor to become a physical and mental well-being people, safeguard social stability and build a harmonious society. In the founding of new China, we had established a dedicated correction organs for illegal minor to educate and correct a large number of minor crimes and explore many effective educational treatment methods in practice for many years. But comparing with reality needs of criminal minor in our country as well as foreign juvenile rectifying system, our criminal minor education rectifying system is not perfect, the quality of correction organs on the minor illegal crime is not very satisfactory and the rate returning to crime is very high. From the status and causes of minor crime, according to minor rectifying system problems, combining with the United States and Germany which are more representative of the minor rectifying system, this thesis puts forward our country in the minor rectifying system should be perfect, bring the correction work into the trial practice, hope there are some benefits for Chinese minor rectifying system formation.This thesis consists of introduction, text and conclusion, three parts. The body part consists of four parts.Part One describes the current situation, reason and development trend of minor crime in our country. Influences of minor crime on China, first of all, analyze the current status and features of minor crime through the relevant cases; Secondly, analyze the minor crime formation causes, including own reasons of the minor, family reasons and the impact of education system on the minor; Finally, summarize our development trend of minor crime.Part Two describes our deficiencies of rectifying system of minor crime. Although our country sets up the corresponding correction organs for crime minor, after analyzing the legislative system and legal enforcement mechanisms in our country, they are deficient. The minor legal system is not perfect in the current legislation; Community correction work mechanism is insufficient; Rectifying system, correction measures and characteristics of criminal minor do not suit.Part Three describes the suggestions on Chinese minor crime correction. First introduce the survey, mechanism and implementation method of foreign minor rectifying system; Secondly, absorb and draw lessons from foreign advanced concepts and advanced methods, according to criminal minor, law system, publicity and education, social supervision mechanism should be perfect, minor rectifying system on non imprisonment treatment, social investigation and community rectifying system should be increased in rectifying mode.Part Four describes the special effects of judicial practice on minor correction work. Judicial practice is an important link for minor correction work which play the role of linking. Therefore, using a special mode of trial, taking pretrial social investigation report system to promote the criminal reconciliation and criminal compensation system, play the characteristics of the people jury system, assist the minor who is sentenced the penalty of unimprison to return to campus and establish community correction project according to the minor physical characteristics. Make the criminal minor really return to society and prevent crimes again.
