China’s Labor Legislation Protection Of Prisoners

The rights of labor are the most basic human rights and civil rights, more and morecountries taken them into theirs constitution.Labor is one of the main means onprisoners’ transformation in the jail of our country,as a "person" and "citizen",prisoner’s labor rights are not because of their penalties to be deprivated.Along with themodern execution idea transformation and the development of the cause of human rights,prisoners’ labor rights protection problem are getting the attention of the internationalcommunity, however the law of prisoners’labor rights in our country is still not perfect,relevant law is too principle, maneuverability is poor; rights system is not complete,there are a large number of blank of law; legislation content lag in socialdevelopment.Therefore the current legislation has been unable to meet the needs oflegal practices, must as soon as possible to be improved.This paper firstly analyzes theimplications and the contents of the prisoners’ rights of labor.Then combined with therights content, research legislation defects.Finally proposed some suggestions ofprisoners’ labor rights legislative protection of our country.
