With the development of our economy and society, the growing number of casesinvolving identity relations, resolving disputes of identity relations, due to the differenceof the different legal basis and institutional settings lead to the ordinary proceedings cannot be an effective solution to many of modern society can not be good to achieve thepurpose of its proceedings, the role of law. Personnel proceedings is a specializedproceedings civil law countries to resolve the identity and relationship disputes,compared with the ordinary proceedings in terms of different theoretical foundation andinstitutional settings. The current status of China’s establishment of specializedpersonnel proceedings conducive to the improvement of the legal system, can play abetter solution for identity relations disputes.This article consists of three chapters, the first chapter is an overview of thepersonnel proceedings, including the personnel proceedings of the concept, andAnalysis of the concept of family law litigation, the characteristics of the personnelproceedings, personnel and litigation and non-proceedings. The second chapter is theestablishment of the legal basis of personnel litigation in China, including theelaboration of the particularity of identity relations, as well as the maintenance of anequitable protection of individual rights and social interests, including the consistencyof our legal system and social development. The third chapter is to build the legal basisdescribed the personnel proceedings, including the scope of the case to determine theestablishment of rules of the principles of litigation and litigation.
