The Research On Chinese Traditional Legal Thoughts

Socialist Concept of the Rule of Law is based on the new concept of managingstate affairs Comrade Hu Jintao as general secretary of the CPC Central Committee,Communist Party of China, the legal theory of Marxism is the great practice of thesocialist rule of law in China, and gradually explore, formed and developed thespiritual culture of the rule of law publicity and education activities, it is to understandand grasp the scientific connotation of the basic strategy of governing the countryaccording to law and building a socialist country ruled up in the highest and deepestlevels, the theoretical basis, of great significance, values, and the principle of principle,the full implementation of the Rule of Law, to speed up the rule of law is of greatsignificance. It has helped the modernization of China’s legal system into the corelevel of legal culture-the concept of the conceptual level. The socialist concept oflaw is not second guess, but absorbed the essence of traditional legal thinking on thebasis of development from the traditional legal thinking and cultural resources andhistorical soil of the socialist rule of law concept. Thus, in-depth understanding ofChina’s traditional legal thinking is the premise of understanding of the meaning andcontent of the socialist concept of law.This article consists of three chapters discussed the first chapter of a simpleintroduction to the concept of the rule of law, the concept of the rule of law, thesocialist rule of law,philosophy, law and culture. The second chapter is the Chinesetraditional legal thought perspective, the traditional Chinese legal thought is profound,this chapter has selected three ideas (the thoughts of Regarding the People asFoundation, the thought of Governing Country by Law and the thought of Using Bothof Courtesy and Laws) discusses. The third chapter is on the basis of the analysis inChapter II, one-to-one correspondence with the previous three ideas,respectively,described the value of these three traditional legal thinking and thecultural contributions of the socialist concept of law.
