Research On Establishing Independent Duty Crime Investigation Organ

The legal issues of investigation power allocation against duty crime are a hot topic, while there are many different points. Investigation power allocation against duty crime influences the efficiency and function of duty crime investigation, so the power allocation should be scientific and rational. This dissertation researches some legal issue of investigation power allocation against duty crime with the following parts:the first part is brief introduction. This part introduces the background and the current research trend of this topic. The second part is the jurisprudential rethinking of power allocation against duty crime. This part introduces and analyzes different points on this issue, and the author maintains that these points are reasonable from their own perspective, but it is more scientific and rational if the organ which in charge of duty crime investigation is independent; the third part is the disadvantages of the current power allocation against duty crime. This part maintains that there is a lack of independence and power control mechanism, so it is urgent to reform it; the last point is the measures to improve the current legal mechanism. This part put forwards that China can adopt some advantages of those countries where exercise independent power allocation of duty crime investigation.
