This paper mainly discusses the problem of reform about the power allocation ofprocuratorial organs’ duty crime investigation. Its main purpose is to eliminate thecentral mistakes of the power allocation,and then to build the stronger duty crimeinvestigation system as well as to enhance the capacity of anti-corruption for ourcountry.About content, this paper mainly focuses on the power of duty crimeinvestigation from four dimensions of,unity,independence, sufficiency, andrestriction.The methods of research base on the theory of judicial rules,and observethe running of the investigation power from the internal and external environment ofthe investigative organization.This paper wants to point out the problem ofconfiguration and the judicial practice of the duty crime investigation power,and tomake suggestions of the reform at the end.About structure, there are three parts in this paper.The first part mainly unveilsthe problem about the configuration and practice of the investigation power;Thesecond part mainly analyses the reasons why it make mistakes on the configuration ofprocuratorial organs’ duty crime investigation power bases on the judicial rules,andexplores the path of change as well;The third part of the paper provides the generalsolution for the reform that separating the duty crime investigation authority from theprocuratorial organs,at the same time, setting up a special duty crime investigationdepartment.At last of this part, the writer puts forward some concrete legislativesuggestions.
