Perfection Of Minor Crime Judicial System

In our country, the situation of juvenile crime has become more and more terrible with a continuous tendency of younger age, which seriously threats the sustainable development of our society and becomes a high social concern. Guided with the criminal policy of combining leniency with rigidity, the improvement of judicial system for juvenile crime has positive significance to help juvenile crimes return to the society and promote the social harmony, since the juvenile are immature. It fits not only the policy of educating, influencing and saving juvenile delinquents but also the principle of giving priority to education supplemented by punishment.At present, there’re many problems on applying the criminal policy of combining punishment with leniency to the minor crimes in judicial practice:it is not uniform in the establishing minor crime special judicial branch. There is unreasonableness on the minor criminal investigation system, procuratorial system, judicial system and the execution system of punishment, and the judicial personnel have few specific standards in enforcing the law. The protection awareness of minor crimes’rights is not enough.To improve the minor crime judicial system complying with the physical and mental characteristics of the minors, we must first establish an independent special judicial institution of minor crime, and establish the minors’public security system, procuratorial system and the court system. The withdrawn system and comprehensive survey system need to be improved in minor crime investigation system. The relative non-prosecution system and reprieve prosecution system need to be improved in minor criminal prosecution system. The minor crime judicial system needs to expand the scope of probation and implement the suspend judgment system. The minor crime punishment execution system needs to relax the applicable conditions of commutation and parole and improve the community correctional system. Minor offender protective judicial system needs to perfect the legal agent system of the minor suspects and establish abolition system of crime record.
