However, in recent years, the government finds that theeffect of equilibrium transfer payment is not obvious with the enlargement of it, even far awayfrom its target. The reason is the legal construction of the transfer payment and theequilibrium transfer payment not sound enough. The intergovernmental transfer payment lackof legal protection and strong oversight in the process of implementation, lead to theequilibrium transfer payment is difficult to play its role in promoting the equalization ofpublic service.Theory comes from practice, while the theory effects on practice. Therefore, not only thesupport of the academic theory, but the breakthrough and the flexibility from the currentsocial situation can be the practical and effective solution to the problems of equilibriumtransfer payment. There are several types of current transfer payments in our country. Authordiscussed the legal system of equilibrium transfer payment draw lessons from part of thetheories of academic circles based on the important effect of equilibrium transfer payment insolving the unequal among areas in the society of our country.Firstly, in this paper author through the description of the present situation that the publicservice enjoyed by residents among different areas in our country is not equal and thecontradiction between the measures used for narrowing gap and the still disparity, pointed outthe system of equilibrium transfer payment was unsound, the mechanism of equilibriumtransfer payment was imperfect, the function of equilibrium transfer payment was lack ofsupervision.Secondly, author made further interpretation of the concept and the characters ofequilibrium transfer payment and clarified the relationships between equilibrium transferpayment and transfer payment, general transfer payment and the background, characters, functions of equilibrium transfer payment based on the problems of the system of equilibriumtransfer payment. That is, the important position and the remarkable effects in finance systemof our country are the explanations of necessity for solving the problems of equilibriumtransfer payment.Again, based on the interpretation of essence of equality in public service and therelationships between equilibrium transfer payment and capacity of government finance,equilibrium transfer payment, the author proved reasons and rationality of research from thevisual angle of public service. These are the reasons of discussing the problems of equilibriumtransfer payment from the view of public service.Finally, author put forward solving the problems of equilibrium transfer payment andachieving the purposes of balance of financial resource among governments and equality ofpublic service among different areas through the constructing a complete transfer paymentlegal system, dividing powers of finance and affairs of government rationally and constructingmechanism of excitation with scientific and flexible mode, based on a series of analysis ofproblems above.
