As a new type of commercial mechanism back of global economic integration era,Business Behavior in Network Transactions has superiority in time and space, speed, costand information. It is made much by government and the community, and develops rapidly.It has become an indispensable part in business. But we still being at an initial stage, theacademic and legislative on it fall behind. As of now, there is not a clear concept about it,not to mention the other theory. On the legislative front, relevant laws just scatterdistribution in other laws. A rounded legal system has not formed. Because of this, thereare many problems appeared, which includes the System of register, contract, responsibility,credit, safeguard, and so on. How to adjust it has become a significant issue in networkbusiness areas.In this article, in order to build a more comprehensive system, research it by methodof Concept Analysis, Comparative Study and Documentary Research. This paper focuseson the theoretical foundation of Business Behavior in Network Transactions. Give anoverview of it, put forward a specific concept, and analyze the elements, types, rights andobligations of it. Basis on the theory, explore and analyze the inadequacies of system ofBusiness Behavior in Network Transactions. After learning the advanced legislativeexperience on foreign, put forward the proposal to perfect the system of register, contractand responsibility, optimize the credit evaluation system, and improve the auxiliary systemof Business Behavior in Network Transaction. The author hopes this article could enrichthe theory, and improve the relevant legal norms. Than adjust it, purify network marker,protect the actors’legitimate rights and maintain the order.
