The Research Of Digital Library’s Fair Use Of Copyright

The library is always developing with technology and also in order to satisfactory the need of people’s culture and information, which turn out to be digital library. But the development of the digital library is encountering the Copyright Law’s obstacles, which make it difficult, and always step into various copyright disputes. In order to develop reasonably and smoothly and clear away some obscure copyright issues.We must continuously improve the Fair Use of Copyright.The introduction of this article states briefly the origin, characteristics of the digital library. And thus leads to the problems which may exist.The text of this paper first departures from the body of the digital library and introduces some of the fundamental problems in the digital library, including its concept, classification and significance and some copyright issues encountered in the development process, especially the problem of Fair Use. By the basic understanding of this chapter, we will have a general understanding of digital library. Chapter two firstly do some theoretical resolution on the Fair use on system, and thus leads to the necessity of Fair Use in the presence of the digital library construction and services. Then a detailed analysis of the conflict between the Fair Use of digital libraries and the rights of the copyright owner that is the exiting problems. Chapter three focuses on the legislation and practice at home and abroad, and highlights a major impact in the worldwide the Google digital library case. So we have a more comprehensive and clear understanding of the current digital library, in order to better serve domestic legislation. Chapter four give some proposals to improve domestic legislation macro recommendations and key specific legislation, including implementing the spirit of the specific system and supporting system perfect.The concluding part of this article state that under the better digital library system and more clearly copyright, the digital library will have a better development prospects and great potential. Of course, we need to explore constantly practice experiences.
