Along with increasing need of health and legal rights, people pay more attention on technology level and service quality of nursing. Nursing work, which tends to be professional and has great quality of service, is an important part of medical and health care. The nurse is clinical workers who have the most medical contact with patients. Therefore, recently, the nurse-patient disputes become a serious problem to the health system, of which do not only to be harmful to patients, but also seriously affect the normal medical rank order or even put the nurse under threat. With regard to the phenomenon that violation of nurse rights is widely exists. Meanwhile, some mistakes, such as inadequate performance of duty, ignoring basic nursing work and lacking of communication with patients, results in serious tension of nurse-patient relationship, of which will affect the quality of care or even cause the nursing accidents. In January23,2008, the "Nurse Regulations" was enacted by the State Council nurses adopted at the206th executive meeting, and shall come into force on May12th of the same year."Nurse Regulation" pays an important role in the maintenance of the legitimate rights and interests of nurses, standardizing nursing behavior, promoting the development of nursing career, ensuring medical safety and health. This paper will analyze the causes of nursing disputes in China, finding that nurse is main reason. At present, the legal system of nurse is not perfect in China, therefore, the author will firstly introduces the relevant legal provisions of "Nurse Regulations". Then it will study related regulations of Japan and the United States on this aspect, and propose suggestions on Chinese law-making. The advanced legislation can avoid disputes, strengthen trust and build harmonious relationship between nurses and patients. The paper consists of the following parts:The first chapter mainly introduces the concept of nurse-patient disputes, basic characteristics and causes of nursing disputes to make difference between the narrow sense of medical disputes and nursing disputes, as well as analyze factors of nurse-patient disputes from several aspects, including nurses, patients and medical institutions and administrative departments. The second chapter mainly introduces the Chinese legislations on adjusting nursing disputes, such as "Nursing Regulations", of which the provisions are the registration system and the rights, obligations and responsibilities of nurses and other related provisions of nurses.The third chapter mainly introduces the basic legal system related to the adjustment of nurse-patient relationship in the United States and Japan, including multi-level nurse registrations, patients’rights and nurse occupation liability insurance laws in Japan.The fourth chapter mainly put forward the legislative suggestions of nurse-patient relationship in our country. The measures contain setting up multi-level nurse registrations, nurse risk prevention mechanism, etc. to perfect our medical system.Finally, the author thinks,"Nursing Regulations" on obligations and liability provisions of nurse rights are too abstract, and lack of operability. There are a lot of nursing system needs to confirm the legal effect by legislation. Therefore, China should accelerate the improvement of the "Nursing Regulations". On the other hand, the current nursing at this specialized health law is still vacant, in order to protect the legitimate rights and interests of nurses, China should effectively adjust the rights and obligations between nurses and patients and pay more attention on the nursing profession, enacting our nurse law or nursing staff law.
