In our country, presenting many kinds of patterns, hospital-patient dispute casesincreased, conflicts between each other became more and more violent for the past fewyears. Now it has been a troublesome problem for hospital, patients and public healthadministration and also a question not easy to judge for courthouse. Being one ofsociety problems, it brings about profound effects on healthy development of hospital,effective treatment for patients, and society stability and harmonious. Therefore,researches on the factors of hospital-patient dispute, especially efficient comprehensivecontrol methods have significant practical importance for healthy development andsociety stability maintenance of medical health service.Through the statistical analysis for hospital-patient dispute cases in three hospitals,three factors producing dispute were determined:medical relief mechanism of thedefects, the defects of medical security system,negative impact of media intervention. Ialso analyzes the legal mechanisms to resolve medical disputes defects, including: thedoctor-patient relationship legal position is unclear; patient disputes the law applicableto the conflict; identification of patient disputes mess.Through the intensification of these patient disputes and legal mechanisms forresolving patient disputes defect analysis, this paper puts forward the patient disputesthe legal settlement of ways: to straighten out the legal relationship between doctors andpatients, the improvement of legislation; unified medical malpractice legalapply;establish a fair and effective medical identification system; establish the patient disputesspecialized mediation system. Constantly improve medical disputes related to theamendment of the law, with the fair and effective medical identification system isestablished, and specialized medical dispute mediation system sound, patient disputesintensification of problems that can be expected to be resolved.
