In recent years, Somali pirates looting the pass-by merchant ransom occurred quiteoften which has become a major security issue to be solved by the international community.Though people have paid a lot of attention on the problem of piracy in Somalia, and alsotaken a series of approach to deal with it, but still cannot extinguish it. This is mainlybecause the missing blank on the judicial trial incarceration system and Jurisdiction whiledealing with the piracy in Somali. So it is necessary to discuss how to solve this problemfrom the point of view of international law.The illustration about the problem of piracy in Somalia can be divided into thefollowing three parts: First part focuses on analyzing the background of the Somali piratesfrom a historical and high level perspective; the second part elaborates the innovation,history and effectiveness of the approaches to punish pirates of international law; the lastpart analyzes the specialty of the Somali pirates which makes a great challenge to theinternational law, in particular, trial and imprisonment difficulties. And also explores thetheoretical solution of the problem of Somali pirates. In the end of this paper, it claims that in order to solve the problem of piracy inSomalia which becomes a harsh security issue. It must involve the judicial trialimprisonment institutional reform and national cooperation.
