Bank card is a powerful tool to carry out security trading by reducing the transaction cost and improving transaction efficiency. Bank card is an effective carrier that is convenient for people’s life so as to improve the overall life quality. Bank card is a kind of important means that the commercial bank can improve the business income and increase the profit sources. Bank card also is an important way that the government can expand consumption demand and promote economic growth.Along with the development of market economy and gradual increase of globalization, with the rapid development of our country banking and electronic information technology, the bank card as a new tool for settlement also gets promotion positively and is convenient people’s life in our country. In the past twenty years, the bank card business of Commercial Banks in China has been developing at a surprising speed.Meanwhile, all kinds of financial crime are more flooding. As a kind of special financial crime, which using bank card is becoming more and more popular. Due to the disadvantages that cardholders’consciousness of protecting their holdings of bank card and password is not strong and commercial bank’s risk prevention is weak, the criminals have an advantage of crime. They use professional equipment by copying cardholders" bank card for fraud, caused many irreparable damage and impact to depositors and banks. Especially, they caused significant economic loss and bad effect on the reputation for banks.This situation requires that cardholders, banks and other relative subjects should clearly know their rights and obligations and targete to strengthen the legal risk prevention, so as to curb the cloning bank card crime in our country providing corresponding countermeasures.
