The Enlightenment Of Extraterritorial Administrative Mediation System To Our Country

Along with the harmonious socialist concept in our country become more and more popular, the alternative dispute resolution gets rapid development. As an important part of the alternative dispute resolution,administrative mediation has been received by more and more civil dispute parties because of its flexibility, professional characteristics, and it also becomes a major choice when the civil parties have dispute. However, due to the administrative mediation system has been ignored and their own defects and other reasons, administrative mediation is not easy to play its proper role. Extraterritorial administrative mediation system is perfect.Therefore, this paper attempts to promote our country’s administrative mediation system through learning and studying the foreign administrative mediation system. In this paper, four chapters are divided to introduce the basic theory of administrative mediation system in our country, outside the administrative mediation system, the flaws of the administrative mediation system in our country, and some Suggestions of perfecting our country’s administrative mediation system is discussed.The first chapter mainly discusses the basic theory of administrative mediation system, including the concept, function and scope of the administrative mediation, administrative mediation and other difference of mediation system, etc. Through this, we can make the reader to understand the basic theories of administrative mediation system in our country.The second chapter is about the scope of administrative mediation system, including France, Japan, the United States, the Netherlands, Spain, etc. Through the introduction to the state administrative mediation system, we can draw lessons from its advantages, thus consummating the administrative mediation system of our country.The third chapter will mainly discusses the enlightenment of Extraterritorial administrative mediation system to our country, first the flaws of the administrative mediation system in our country are discussed;then necessity and feasibility of establishing administrative mediation system in our country, last discusses the enlightenment of Extraterritorial administrative mediation system to our countryThe fourth chapter is the focus in this paper, based on the theory of administrative mediation system in our country, outside the administrative mediation system are analyzed, in pointed out the flaws of the administrative mediation system in our country, on the basis of put forward some suggestion for the perfection of administrative mediation system in China.Finally in the conclusion part,l summarizes the administrative mediation system, hoping to play a bigger role in the actual operation.
