The Constitutional Regulation Of Authorized Legislation In China

As the name implies, authorized legislation is the system about legislative authority.It’s the product of changing modern society which challenge the theory of traditionalconstitutionalism. Although conforms to the practical needs, it against the principles ofthe Constitution which require democratic legislation. With the development of legalsystem in China, this problem should be solved. Therefore, I hope to explore thesurvival of authorized legislation and gradually make its system approach to theessential requirement of constitutionalism to avoid the questions about its democraticand legitimacy. Because of this, in this paper, I would analyze the authorized legislationsystem and its constitutional regulation problem in China from the constitutionalstand-point. First of all, I would define the meaning of authorized legislation in thecontext of Constitution. Then I would discuss the meaning and fundamental principlesof regulating authorized legislation under the constitutional rules. At last, I wouldanalyze problems which exist in our country and make suggestions directly to perfectour authorized legislation on this basis to find the development way of it withinconstitutional framework, and to contribute to Chinese construction of law andConstitution.
