The Study On The System Of The Right Of Lawyers-on-Site In China

Criminal Investigation Behavior prevalent torture, random search, arbitrary detentions and other problems, the reason lies in the defect of China’s current Investigation System. In many constructive proposals, the introduction of the right of lawyers-on-site, is undoubtedly one of the more direct and effective way to protect human rights. This dissertation analyzes the meaning of the right of lawyers-on-site. According to the experience of foreign countries and China’s actual situation, gives suggestions on the establishing of the system of the right of lawyers-on-site at interrogation in China.This article firstly introduces the concept and the fundamental theory on the right of lawyers-on-site. Secondly introduces the legislation on the right of lawyers-on-site of other countries, involving countries of the Anglo-American law system and countries of continental legal system. Then illustrates the necessity on the establishing the system of the right of lawyers-on-site at interrogation in China. The establishing of this system has its practical values.The feasibility of establishing the system of the right of lawyers-on-site. Finally gives suggestions on the establishing of the system of the right of lawyers-on-site at interrogation in China.
