Analysis Of Drunk Driving Behavior In Our Country Of The Criminal Legislation

In recent years, with drunk driving is serious, leading to the traffic accident frequency, the serious threat to people’s property and safety. And to the dangers of drunk driving, the largest drunk directly lead to a large number of casualties and property losses, a serious threat to the masses of the people’s property and safety, caused social public attention. Therefore, the11th National People’s Congress standing committee passed the amendments to the criminal law of the People’s Republic of China (8), will be a drunk crime write formal criminal law.This article will first from the criminal legislation of drunk driving behavior dynamics, from the Angle of psychology, analyses the reasons of the existence of drunk driving behavior, and, in turn, will be serious social harmfulness of drunk driving and the combination of traffic status in our country, the criminal legislation of the origin, concept and standard aspects of in-depth analysis of drunk driving behavior of the criminal legislation, and illustrates in detail the evolution of the drunk driving behavior of criminal legislation in China. Secondly, this paper based on theory of law, pay attention to the interpretation of the concept of Ming, from the definition of drunk driving behavior, drunk driving behavior of crime constitution, drunk driving behavior crime and relevant crime analysis in three aspects, such as theory analysis on drunk driving offence. Finally, based on perfecting the drunk driving behavior level of criminal legislation in our country, puts forward some related legislative proposals, such as:drunk driving standards, help the drunk driving behavior regulation, judicial practice how to strict law enforcement, etc.
