| Political legitimacy is always of great significance in the study of politics. Strengthening thepolitical legitimacy is an important condition for those in power to get stable politicalgovernance and realize political ends. Nowadays, the abuse of public rights and corruption hasseriously damaged the legitimacy among the ruling class. Corruption has already become the toppublic enemy against political legitimacy. To eradicate corruption is gradually drawing moreimportance in the construction of enhancing the political legitimacy. Anti-corruption andadvocacy of clean government are one of the major topics in the eighteenth National Congress ofthe CPC. Corruption is not only a conspicuous obstacle blocking the construction of politicallegitimacy, but seriously hinders a further development of market economy and harmonioussociety. Official property report system which is also knew as “the sunshine laws”, originatedfrom Sweden two centuries ago. It is regarded as the most powerful tool in the process ofanti-corruption and advocacy of clean government as well as an effective way in strengtheningthe political legitimacy. At the present, more than100countries have carried out that system inthe form of law. Official property report system is a system which requires the civil servantsreport his property to the related institution within the stipulated time and accept the inspectionand supervision of related institution. Official property report system does not clash with theprotection of privacy. Firstly, under the system of representative democracy citizens have therights to know the basic information of the representative s they selected. As the agents toexercise the political rights on behalf on the citizens, representatives should meet the public rightto know. Secondly, the social role of government officials decides that it is their obligation todisclose assets. Thirdly, the official property report system is also a proof and protection of thegovernment officials’ legal interest. In our country, the implement of such system will contributeto enhancing the public trust of government, which is a response to the public will and aneffective way of regularizing officials’ behavior as well as a necessary complement to thedemocratic construction in our country. However, the official property report system has not yetput into practice actually. There are various reasons. To start with, the current Regulation aboutLeading Cadres Reporting Related Personal Affairs has many deficiencies. Secondly, there existno laws and regulations assuring the implement of the system. There are other reasons such as alack of relevant institution and mechanism, the misconduct of supervising officers and theimperfection of supervision system, etc. The reasons for the current situation are also various. Onthe political level, the socialist democracy in our country is still in the phase of development and improvement, in many aspects, it needs a further research and complement. Moreover, seniorleaders worry about the stability of politics and economy after the fulfillment of the system. Onthe economical level, the unbalanced economic development between different regions is amajor factor for income inequality, the disclosure of official’s asset in different regions mayeasily intensify the existing psychological imbalance. Furthermore, the execution of the systemwill cost a large amount of manpower and material resources, which will pose a big pressure onthe finance of our country. On the other hand, before the supporting system is improved, it isimpossible to prevent corrupt officials from transferring illicit property efficiently. If not doneproperly, there would be a loss of state-owned assets. On the level of ideology and culture, thefeudal and conservative though are deeply rooted, which caused an official standard thought anda mentality to shroud their wealth. The mental contortion of the public who hate the rich and thepowerful also block the carrying out of the system. In order to remedy the deficiencies of thesystem and avoid the risks after the system is put into practice. This paper first draws someexperience from abroad and analyzes how to carry out the official property report systemaccording to the situation in our country. And then improve the system design from the followingseven perspectives based on the current regulation: the report contents, the report subject, thereport process, the way of disclosure, the punishment measurement and supplement andattentions. At last, the paper offered some measure and suggestions to insure the actualfulfillment of the official property report system. |
