The construction of urban community autonomy has yielded some results, but alsoaccumulated some experience. However, with further in-depth development of theurban community autonomy, as well as the process of the society based on the rule oflaw to speed up seriously lagging behind the imperfect legal system of China’s urbancommunity autonomy, relevant laws, regulations, increasingly limit the development ofcommunity autonomy. The main legal basis for China’s urban community autonomyUrban Residents Committees of the People’s Republic of China Organic Law, the lawpassed on December26,1989has been implemented for20years, less its contents, only23provisions, is not detailed enough content requirements, it is compared with theprinciple of legal provisions lack of interoperability, the contents of the relationshipbetween neighborhood committees and governments, communities, civil societyorganizations, and the terms of reference of the specific provisions. In recent years,every year during the NPC session, there are many NPC deputies jointly proposed amotion to seek to amend the Organic Law of the Urban Residents Committees. Indeed,since the community building propulsion of neighborhood great changes in the work ofcommunity self-there are a lot of new situations and new problems, the current legalcontent can not fully meet the needs of the development of urban grass-roots democracy,the urgent need to modify.A preface and conclusion, there are four main parts. The first part is an overview ofthe theory of the autonomy of the urban community. Main meanings, concepts, elementsof the urban community autonomy, be a simple theory for the urban communityautonomy combing. Community evolution and changes in our administrative pointedChief communities in several performance specific practice, the second part of oururban communities autonomous status quo and problems of the legal system analysis.First introduced from the autonomous legislative status quo of China’s urban communities. Including the constitutional level, the level of laws and regulations,departmental rules and local government provisions are introduced. Autonomous legalsystem of China’s urban communities exist dislocated from the relationship between theurban community autonomy legislation, government administrative and communityautonomy, community self-resident participation, community supervision mechanismanalysis; Part III The extraterritorial urban communities autonomous legal systemComparative Study. The City, Germany, Singapore, Taiwan, urban communityautonomy legal status quo, and pointed out that the development of communityautonomy without government regulation and strong support, but the administrativemeans of intervention should be relaxed in the management mode. The fourth part is theautonomous legal system of China’s urban communities countermeasurerecommendations put forward relevant countermeasures and suggestions from thelegislation, residents participate in the mechanism, improve community self-supervisionmechanism.
