The development of biological technology make a spurt of progress, especially the rapid development of transgenic technology in recombinant DNA technology in the early nineteen seventies the birth and the consequent, the biological technology in the fields of agriculture, forestry, fishery, medicine and environmental protection play an increasingly important role.From history of the transgenic technology development, we know that the patent protection system in the course of promoting the development of transgenic technology has played a role,which can not be ignored. The relevant patent transgenic technology argue not only covers a wide range, long time, also had a great impact on the development and change of the patent system itself. Comparison of the detailed analysis of the different practices at home and abroad, I think that we should put the transgenic technology and its related into China’s law on the protection of patent scope.As the science and technology as a "double-edged sword", transgenic technology brings a lot of convenience to people at the same time, also sounded the alarm for human. Transgenic technology is there risk? Genetically modified products are safe and reliable? So the legal relationship arising in transgenic technology research,development, and application of adjustment in the application of economic law, is legal. In the view of economic law, this article discussed the legal issues raised by transgenic technology, also analyzed and compared the similarities and differences between Europe and the United States and other countries of the transgenic technology of safety risk of legal protection, the international trade dispute settlement mechanism of transgenic products.
