Study On Legal Regulation Of Environmental Risk Of Transgenic Technology In China

since the rotation of gene technology has came into the public view,it has been confronted with many questions.From this point of view,the research on the safety risk management of transgenic technology has been entered into the academic perspective.In the background of the research on the safety risk of transgenic technology gradually into the deep water area,the research on the risk of food safety faced by the transgenic technology has been strengthened,and the research results are quite abundant.Although the safety risks of transgenic technology involve environmental safety risks,there are few such studies.How to analyze,integrate and absorb the existing research results of guiding principle of "risk prevention",safety evaluation management institution and environmental tort liability institution and so on,and improve the legal system of environmental risk of transgenic technology in China will become another key point in the future research.The full text consists of five chapters,the specific contents are as follows:Chapter first focuses on the significance of the topic,the status quo of research on environmental risk law of GM technology at home and abroad,research methods and innovations,through the description of the abovecontent,and then launches the discussion of this article.The second chapter mainly elaborates the concept and form of environmental risk of genetically modified technology and analyses the necessity of legal regulation.It mainly involves the concept and development status of genetically modified technology,the expression form of environmental risk of genetically modified technology and the necessity of legal regulation of environmental risk of genetically modified technology.This chapter mainly wants to demonstrate and analyze the necessity of regulation from the perspective of the principles of GM technology and the environmental rights and the public’s right to know.Chapter three mainly analyses the current situation of the legal regulation system of environmental risk of genetically modified technology in China,including legislation and supervision.At the same time,the shortcomings of the specific system in the legal regulation system of environmental risk of genetically modified technology in China are analyzed,mainly focusing on the legislative system,legislative rank,supervision and security system,which paves the way for the improvement of the legal regulation system of environmental risk of genetically modified technology in China.Chapter four analyses and compares the legal system of environmental risk regulation of GM technology in foreign countries,mainly focusing on the legislative principles,evaluation system and supervision guarantee system of the legal system of environmental risk regulation of GM technology in Europeand the United States,so as to draw inspiration for the improvement of relevant legal system in China.Chapter five,aiming at the current situation and shortcomings of the legal regulation system of environmental risk of genetically modified technology,puts forward corresponding suggestions for the improvement of the legal regulation system of environmental risk of genetically modified technology in China on the basis of referring to the specific legal system of foreign countries,mainly involving four aspects: basic principles,legal content,supervision and guarantee system.
