Study On The Legislation Of Rural Medical Assistance In China

As a result of the implementation of China’s long-term impact of urban-rural dual structure, China’s poverty-stricken population mainly concentrated in rural areas, among which, the phenomenon of "poverty caused by illness, poverty returned by illness" has become the main reason for rural residents living in poverty. It also impacts and constraint of China’s social stability and building a new socialist countryside. Medical assistance project is an indispensable and fundamental part of social security system for rural communities. It attempts to establish policies to provide allowance for the rural residents to have their diseases cured. Medical assistance project is also a necessary measure for the establishment of the harmonious society. Establishing and completing rural medical assistance system is of great significant to such aspects as lightening the burden of rural poverty-stricken population, enhancing their health level, improving their life conditions, promoting rural economic development. After10years of development, the course of rural medical assistance in China has achieved relatively great success. However, due to various factors, there are still some urgent problems in practice, such as, the relevant legal system is not perfect, the capital investment is insufficient, the connection with the new rural cooperative medical care is inadequate, and so on.This thesis, by interpreting the medical assistance system in China, is based on the analysis of the large number of documents and materials; it is about how to improve our country’s rural medical assistance legislation. This article is divided into six parts. The first part introduces the topic of research background and significance, and then describes the current domestic and international research on the subject of rural medical assistance. The second part is divided into the first chapter. Starting from the legislation of rural medical assistance, first introduced the meaning of rural medical assistance. And then introduced the definition of the concept of rural medical assistance and the based on the philosophy of law. The third part is divided into the second chapter, anglicizing of the current legislative situation of medical assistance in rural China, concluded that medical assistance legislation level is too low, lack of authority. Then introduces the rural medical assistance’s problems in detail, such as the lag of legislation, the low legislative level; the management system is not effective, the connection with new rural cooperative medical system is not in place. The forth part is divided into the third chapter. In this chapter, we starting from the above analysis foundation, expounds the necessity and feasibility of legislation of rural medical assistance. The fifth part is divided into forth chapter. Introduce several typical countries’medical aid experience and domestic typical medical assistance model selection, then draw the experience important:the importance of legislation; emphasisi on state responsibility; the establishment of a multi-level assistance system. The six part is divided into fifth chapter From the aspect of legislation, analyzing of rural medical assistance legislative work should adhere to the principles, legislative model and the specific institutional arrangements of the proposals and ideas.
