Education is an activity to cultivate human beings. Different kinds of socialfactors constraints the developing process of education. With the social-economic,political, and cultural development and the changing times, people’s attitudetowards education is changing, the differences understanding of the educationproperty issues has a direct impact on education and contemporary socialsynchronization developments. With the industrialization of education graduallyincreased, the public-good of education behind the industry has attracted people’sattention. This shows that education commonweal has produced a certainproblems. We have been ambiguous concerned about the education public interest,but it has not addressed the public good of education and make substantiveinitiatives. The project of vital and lasting importance is education.The project ofvital and lasting importance is to public-good is the core of education propertyembodies the nature of education. As a pure public education and national defensesystem, government, legal system, environmental, like overall, has the interests ofimpartiality, fairness, and other characteristics. How scientific and reasonablemaintenance the education for commonweal is a question worth considering for us,as a powerful country in education, the United States also exists a series ofproblems of complex background factors. The study of American commonwealeducation can contribute to more comprehensive public service awareness andunderstanding of education, which will help our country to learn from theexperience, provide a favorable reference for China’s educational causes.The research’s main methods include: literature, case studies and comparativeresearch method. This thesis mainly consists of five main parts. The first part isthe introduction. It introduces the problem to study the meaning, definition,domestic and international literature review and research methods. The secondpart is the historical evolution of American commonweal, it is divided into theintroduction of relevant laws and cases in the formation and development ofpre-World War II and after World War II, and it gradually improve the process.The third part is the public confirmation of American commonweal education. Itincludes the confirmation of the American commonweal education global, comprehensive, interests, public and fair nature. This section attempts to clarifythe education of public commonweal of the five characteristics involved in themain influencing factors and constraints in the main body, a more comprehensivehelp to understand the commonweal education. The fourth part is education’spublic legal protection of America. Firstly, it analyzes and elaborates the publicwelfare legislation to protect American education. Followed by the blackeducation, female education, education for the disabled and family education, thejudicial protection of public welfare to the American education are discussed. Thefifth part is mainly the reflection and reference. Including the confirmation ofChina’s commonweal education, public welfare of the problems in China’seducation, and recommended the maintenance of public service to education inChina.
