Rencently,TBT as a more hidderu、more subtle and more legal form play a very important role in internation trade.TBT includes technology rules、tech-standards and conformity assessment.General TBT also includes Packing and labelling requirements and sign、green barrie、IT barriers and so on.TBT works throug raising export cost、making strict inspection and certification,refusing inconformity products import.As high-tech products in international trade share more and more, the protection of intellectual property rights for technology products trade are constantly strengthened,therefore,the combination of technology and intellectual property has becoming a new trend applied widly in the international trade, which make technology a patentent.With a product technology fusion is becoming higher an higher,it becomes a need to cross licensing the technology among a few companies,then with more and more companies joining, to avoid inefficiency when bilateral crossing and add key patents,it needs companies share its key patents,and build a patent pool,which is the combination of technology standards and patent pool.In the technology communication field,every patentee choose to build patent pool to save cost and aquire more service fee.Besides,because high-tech industry has a higher demands on technology standards commonality and compatibility.Which makes the competition among technology standards more important and produce Credible-threat.Through Empirical Analysis for 3G、TD-SCDMA, we can see that building a patent pool can save transcation cost,and make patenee who own more key patents and would like to join in the patent pool acquire more patent right yield than they outside the patent pool.
