As China’s first industry, agriculture, and its steady growth for China’s national economic development is of great significance. China is a large agricultural country, but China’s agricultural scientific and technological level still lagging behind to achieve the modernization of agriculture is still a long way to go. In order to solve China’s "San Nong" issue and realize the farmers increase their income, agricultural growth, rural areas of good and stable situation, we must rely on advanced agricultural science and technology promotion. Agricultural patents as the most advanced, most creative, most practical agricultural science and technology, is to promote the rapid development of China’s agriculture, accelerate agricultural modernization to achieve an important force. Therefore, we need to study the development of China’s agricultural patent in depth.Under such background, this article first takes China’s agricultural patent applications’ data in1985to2005as the object of study, uses the descriptive statistical method to study the present situation of the China’s agricultural patent application. The results showed that: although the number of China’s agricultural patent applications grow more rapidly, relative to the increased speed of the number of all patent applications, its speed significantly behind; the number of agricultural patent applications account for a lower proportion of the number of all patent applications; the number of patent applications in agriculture show clear regional differences and differences in the range of technologies; invention patents occupy a dominant position in the agricultural patent awards type; individuals become the major force in patent applications in agriculture. On this basis, this article uses the panel data model to study the influencing factors of the China’s agricultural scientific research institutions’ agricultural patent applications. The results showed that:according to various factors’ influencing degree, from large to small in turn are:the number of scientific research projects, the number of people who are with the master’ degree and engaged in scientific and technological activities; total output value of agriculture, forestry, animal husbandry and fishery; scientific instruments and equipment purchase costs; the annual income of the scientific research institutions. In addition, the number of agricultural patent applications in China’s major agricultural provinces depends on the five kinds of factors greater, and the mid-west economically backward localities’ agricultural patent yield rate is higher.This article content mainly divides into five parts. The first chapter is the introduction, introduces the research background of this article, the content and the goal, the main research technique and so on, and summarizes the article innovation and the insufficiency. The second chapter is the literature summary and the rationale, carries on to the domestic and foreign related agricultural patent’s literature reviews and elaborates this article’s rationale. The third chapter uses the descriptive statistical method to analyze the present situation of China’s agricultural patent applications, explains the development of China’s agricultural patent and existing problems. The fourth chapter uses the panel data model to study the influencing factors of the China’s agricultural scientific research institutions’ agricultural patent applications, calculates the degree of various influencing factors and draw conclusions. The fifth chapter gives conclusions and related policy suggestions.
