Study On Perfecting China’s Drug Recall System

Since the implementation of The Drug recall management approach in2007, our drug recalling system, starting from scratch, has constantly developed and made great achievements during its four years explorations and practices. It further improves public drug use safety and protects legal rights of consumers. However, Perfecting process of a system requires ceaseless explorations and practices. Newly established, the drug recalling system contains drawbacks. Many relevant issues in lawmaking and sequent measures are waiting to be researched and discussed. The safety of drugs arouses attentions from the whole society. To perfect the drug recalling system plays a necessary part in setting up our long term drug safety supervision mechanism. The United States established the earliest drug recalling system. Their practical experience of years, standard system, strict procedures and high operability are worthy for us to study.This article starts from the analysis of the drug recall system by related theories. Following are comparative analysis of examples between China and the United states. By comparisons, it points out the existing problems of our drug recall systems in lawmaking and implementation, and then makes suggestions to improve current drug recall system.The article is divided into four parts:The first part reviews the legislation background of our drug recall system and defines basic concepts such as drug recall, legislation and procedures of drug recall, then comes to clarified the definition of drug recall and its similar concepts.In the end,It illustrated the significance of drug recall.The second part introduces the drug recall system in the United States and the differences of Chinese drug recall system. Later, it indicates obvious problems of our drug recall system in implementation by analyzing typical cases.The third part indicates obvious problems of our drug recall system and their causes in aspects of lawmaking and sequent measures.The fourth part points out drawbacks in our current drug recall system and makes suggestions in the following areas:to strengthen supervision mechanism of adverse drug reaction, to perfect legislation of drug recall system, to clarify public informed system, to establish mechanism of recall compensation and relief.
