Recent years, foreign investment has become one of the major sources of the realty business in our country. For the purpose of guiding foreign investment in real estate and keeping order of realty business, country and each department unveil series regulations. The author starts off on the development history of foreign investment in real estate, exploiting the way and modus of foreign investment inflowing in China realty business, discussing the new character of foreign investment in China real realty in current period and analyzing the positive and negative effects on this basis. And then the author exploits the current legislation status, regulation principle and specific measure of foreign investment in China, thereby summarizing three problems:the supervisory and legal regulation of real estate in China is ambiguous, the default of Scientificalness and fairness in realty business of China, the controversy and connection problem between realty policy and WTO principle. Finally, the author puts forward a suggestion to improve the regulation of foreign investment in real estate from such aspects as:legal regulation of the reconstruction and improvement, modification and refinement of the foreign exchange laws and policies, complement and strengthening of tax laws, regulation of industrial policy and upgrade of guidance functions, supervision of real estate market and construction of legal system.
