Chongqing Main Existing Problems In Land Expropriation And Compensation Work And Countermeasures Research

Since the reform and opening up, our nation’s economic development and urban construction received rapid development. Thus lead the land using greatly increased and more land disputes occurred which has already been the focus of society. As the newly municipality directly under the central government, Chongqing is outstanding for its typical countryside and city dual structure. Otherwise, as the core area of the politic, economic and culture of the city, the nine main districts faced lots of problems in land expropriation because of the contradiction between the limit of land resources and the necessary of urbanization development.Based on the theories of land expropriation, by comprehensive comparison on the land expropriation systems and regulations between both China and other countries, studying the specific example that met during the process of land expropriation in Chongqing, the existing problems encountered in the nine main districts were studied in this paper. First, there are some problems in land expropriation process, such as lacking of openness, no participation opportunity for the owners of land and the owners’ hearing right can’t be well guaranteed. Secondly, the compensation standard was static and low, the compensation scope was narrow. Thus lead the protection of the owners’ right could not be enough emphasized. They also lack of judicial remedy and reemployment training. Beside of these problems, there also exited that the disposal management of rural collective assets couldn’t be standardized and some public servants didn’t carry out the duty carefully and execute to the bottom.According to those problems the nine main districts of Chongqing faced, this paper puts forward some suggestions. Hearing instance should be strengthened, the content of announcement should be comprehensive and easy to understand by peasants and the information should be send with multiple channels. The judicial remedies should be consummate and the farmer’s right should be protected. Determine the land compensation standards in the market economy system and expend the compensation scope. Obtain employment placement of the peasants who lose their land should be bring into the cadre achievements appraisal system. Built comprehensive accountable mechanism to promote a credible and administrative efficiency.
