Study On Foreign-invested Enterprise Examination And Approval Of Jinan City

More than thirty years from reform and opening up, foreign-invested enterprises(FIE) develope rapidly in China, and while they effectively promote China’s economic and social progress, they also brought negative impact such as environmental pollution and energy consumption. FIE examination and approval has played an important role in regulating and guiding scientific and effective use of foreign investment. Since the founding of the first FIE in Jinan on July15,1985, Jinan FIE examination and approval has gone through nearly thirty years. With the rapid development of economic globalization, the gradual progress of the extensive application of information technology as well as service-oriented government building, Jinan FIE examination and approval exposes many problems, which to some extent affect foreign investment environment, restrict the healthy economic development and increase opportunities for administrative corruption. How to further improve Jinan FIE examination and approval remains a problem urgently needing to be solved, for the purpose that the utilization of foreign investment is compatible with the economic and social development goals, for catching the development opportunities, and for releasing development potential.With the method of literature research and empirical research, this paper elaborates the characteristics and achievements of Jinan FIE examination and approval, sums up the problems such as the complex basis, cumbersome procedures, dispersed functions, and backward processing methods of FIE examination and approval brought by the absence, offside and dislocate of government functions, analyzes the causes which are at the national level, the complex approval legal system, the inefficient registration patterns, and the supervision disfunction, and at the local level, the influence of the traditional management system, the rigidity of approval departments and the lack of inner motivation, and finally gives countermeasures, which are, at the national level, focusing on the top-level design, to rationalize the legal system, to adjust approval process and function, and to strengthen the supervision of FIE examination and approval, and at the local level, focusing on re-perfect and execution, to strengthen public participation in the formulation of normative documents, to build flexible approval process, and to speed up the pace of on-line approval construction.This paper is divided into five parts. The first part is the introduction which tells the background and significance of the topic, analyzes relative research and the innovation of this paper, elaborates the framework and research methods of this paper. The second part is about the relative concepts of FIE examination and approval, and the policies and regulations at the national level. The third part is about the development of FIE examination and approval of Jinan City, which is a summary of the legal policy systems of Jinan FIE examination and approval at the local level, and the Jinan’s efforts to improve the FIE examination and approval, in order to improve the environment for foreign investment. The fourth part is about the problems and the reasons of FIE examination and approval of Jinan, which reflects and summarizes Jinan FIE examination and approval, in order to find a way to improve the examination and approval work. The fifth part is about the countermeasures to improve Jinan FIE examination and approval, seeking an effective way to solve the practical problems referred in the fourth part at both the national level and the local level.
