In the last two decades, due to the changes taken place in the world economy and politics, many countries have reformed their domestic laws and regulations on investment. It has brought them more flexible and globalized investment patterns and brought about numerous disputes in this field. Investment disputes between states and nationals of other states, which have aroused wide concern in the international community due to the special identity of the subjects.In the1960s, the Convention on the Settlement of Investment Disputes between States and Nationals of Other States (Washington Convention) was formulated, which has laid a legal restriction on investment disputes between states and nationals of other states. Later, with the special purpose to settle this kind of investment disputes, the International Center for Settlement of Investment Disputes (ICSID) has been established in favor of the general public. It is a prerequisite and kernel task for a dispute settlement mechanism to specify its jurisdiction in order to function efficiently. Therefore, only through a more scientific analysis and research of the jurisdiction of a mechanism, can we make greater use of it.This thesis begins with a study on the application of Article25of the Washington Convention, and furthers its research into the jurisdiction of ICSID. The thesis includes five major parts:a brief introduction on Article25of the Washington Convention, the subject, the subjective, and the objective conditions of jurisdiction of ICSID, and the enlightenment on Chinese practice. The author tries to outline and explain the problems concerning the application of Article25and the jurisdiction system of ICSID. hoping that it may benefit China and Chinese people’s participation in international investment, and may help resolve some international investment disputes as well.
